GENERAL REQUIREMENTS UNDER THE H-1B WORKING VISA:
- You have to receive a job offer from the employer in US;
- The Employer must obtain a permit for your employment from the United States Department of Labour;
- The occupation itself must be a highly skilled occupation that requires a minimum a Bachelor degree-level qualification or equivalent education. In certain cases, degree can be substituted with the proven significant work experience in the relevant occupation. Your experience and education have to match the job description.
- You can only work for the employer that applied for you to USCIS

- H-1B visas are granted for an initial period of 3 year stay in the USA. Your spouse and unmarried children under 21 years of age, who wish to visit, accompany or join you in the US may apply for the applicable visa to join you, but spouses are not entitled to work in the United States.
